1. Agreement to Terms
By accessing and using Adjuster Dispatch, you accept and agree to be bound by the terms and provisions of this agreement. Adjuster Dispatch is a nationwide marketplace platform that connects independent licensed professionals with insurance companies, adjusting firms, and other businesses seeking professional services for claims assessment, mitigation, and resolution. If you do not agree to abide by these terms, please do not use this service.
2. Service Description
Adjuster Dispatch operates as a neutral, nationwide marketplace platform. We do not employ professionals or hiring organizations, nor do we make hiring decisions. Licensed professionals and hiring firms use our platform to connect and conduct transactions independently, regardless of their location within the United States. Adjuster Dispatch facilitates these connections but is not a party to any services rendered or contracts entered into between users.
The platform serves professionals including but not limited to:
- Insurance adjusters (staff, independent, and catastrophe)
- Construction contractors and restoration specialists
- Structural and mechanical engineers
- Forensic experts and loss assessors
- Attorneys and legal professionals
- Other qualified professionals involved in claims assessment and resolution
3. User Eligibility and Accounts
To use Adjuster Dispatch, you must be at least 18 years old and have the legal authority to enter into binding agreements. If you are a professional service provider, you must maintain all necessary professional licenses, certifications, and credentials as required by applicable law and regulation in your jurisdiction(s). If you are an insurance company, adjusting firm, or hiring organization, you must be a legally registered entity authorized to conduct business in the United States. You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. Adjuster Dispatch may immediately suspend or terminate your account if you provide false information, violate these terms, or engage in unlawful activity.
4. Marketplace Conduct and Prohibitions
You agree that you will not:
- Engage in fraud, misrepresentation, or deception in any marketplace transactions
- Violate any applicable federal, state, or local laws, including licensing and professional regulations
- Harass, threaten, or harm other users of the platform
- Use the platform for any unlawful purpose or in connection with any illegal activity
- Attempt to circumvent the platform to conduct transactions outside of Adjuster Dispatch
- Copy, reproduce, or distribute any proprietary materials, algorithms, or code from the platform
- Reverse engineer, decompile, or attempt to access the platform's source code
- Impersonate another user or misrepresent your identity, credentials, or qualifications
- Post false, misleading, or defamatory information about other users
- Solicit users for offline engagement to avoid platform fees or oversight
5. Independent Contractor Relationships
All transactions facilitated through Adjuster Dispatch result in independent contractor relationships. Professional service providers are independent contractors and are not employees of Adjuster Dispatch or any hiring organization. Each party is responsible for compliance with all applicable employment, tax, licensing, and regulatory requirements. Service providers are responsible for obtaining all necessary business insurance, professional liability coverage, and workers' compensation insurance as required by their profession and jurisdiction.
6. Professional Licenses and Compliance
If you are a professional service provider, you represent and warrant that you possess all licenses, certifications, credentials, and qualifications required to practice your profession in your state and any other jurisdictions where you perform services. You agree to maintain these credentials throughout your use of the platform and to comply with all applicable professional standards, codes of conduct, and regulations. You must disclose any professional disciplinary actions, license suspensions, or restrictions. Adjuster Dispatch does not conduct background checks, license verification, or credential authentication on your behalf.
7. Scope of Services
Adjuster Dispatch is a platform for connecting service providers with organizations that need professional expertise for insurance claims-related work. This may include damage assessment, repair estimation, expert consulting, legal services, engineering analysis, forensic investigation, restoration coordination, and other related professional services. Each transaction is specific to the parties involved. Adjuster Dispatch does not guarantee specific outcomes, quality of work, or satisfaction with services rendered. All service terms, pricing, scope, and deliverables must be negotiated directly between the parties.
8. No Warranties or Guarantees
Adjuster Dispatch is provided on an "as is" basis. We make no warranties, expressed or implied, regarding the platform, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the platform will be uninterrupted, error-free, or free from viruses or harmful code. We do not warrant the accuracy, completeness, or reliability of any user profiles, information, credentials, or ratings on the platform. We do not warrant the quality, competence, or professional ability of any service provider, nor do we warrant the legitimacy or financial stability of any hiring organization.
9. Limitation of Liability
To the fullest extent permitted by law, Adjuster Dispatch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to use the platform in the twelve months preceding the claim.
10. Assumption of Risk
You assume all risk associated with your use of Adjuster Dispatch and any transactions facilitated through the platform. You are solely responsible for evaluating the qualifications, credentials, experience, and reliability of any professional or hiring organization before engaging in a transaction. Adjuster Dispatch does not conduct background checks, license verification, credential validation, or safety screening. You are responsible for conducting your own due diligence and verifying all information provided by other users.
11. Payment and Fees
Adjuster Dispatch charges fees for the use of the platform. Fees may include one or more of the following:
- Platform credits. Access to certain platform features, including posting and dispatching claim assignments, requires the purchase of platform credits in advance. Credits are consumed when specific actions are taken. Purchased credits are non-refundable except as required by applicable law.
- Transaction or service fees. Adjuster Dispatch charges a percentage of the task or assignment fee as a platform service fee. Applicable rates are disclosed before you incur them.
- Subscription or plan fees. Adjuster Dispatch offers subscription plans that provide access to platform features at a fixed recurring rate. Applicable rates and billing terms are disclosed at the time of enrollment.
All applicable fees are clearly disclosed prior to your acceptance of any charge. You are responsible for all taxes, withholdings, and other legal obligations related to payments made through the platform. Payment disputes between service providers and hiring organizations must be resolved directly between the parties; Adjuster Dispatch is not responsible for payment disputes, non-payment, collection issues, or billing disagreements arising from services rendered. Adjuster Dispatch reserves the right to suspend or terminate accounts for non-payment of platform fees.
12. Intellectual Property
All content, design, text, graphics, and other materials on Adjuster Dispatch are the property of Adjuster Dispatch or its licensors and are protected by copyright and intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit, or distribute any materials without our prior written consent. You may only use the platform for lawful purposes in accordance with these terms.
13. Indemnification
You agree to indemnify, defend, and hold harmless Adjuster Dispatch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of the platform, your violation of these terms, your violation of applicable laws or professional standards, or any transaction you engage in through the platform.
14. Dispute Resolution
Any disputes arising out of or related to your use of Adjuster Dispatch shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to jury trial or class action lawsuit. The arbitration shall be conducted in the state of Florida in accordance with Florida law. Each party shall bear its own attorney's fees and costs unless the arbitrator determines otherwise.
15. Modifications to Terms
Adjuster Dispatch may revise these Terms of Service at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of the platform following notification constitutes acceptance of the revised terms. All modifications apply prospectively only. Any dispute arising from conduct that occurred prior to the effective date of a revision will be governed by the version of these Terms of Service in effect at the time of that conduct.
16. Termination
Adjuster Dispatch may suspend or terminate your account at any time, with or without cause, at its sole discretion. Termination may occur due to violation of these terms, unlawful activity, non-compliance with applicable regulations, professional misconduct, or any other reason. Upon termination, your right to use the platform immediately ceases. You remain liable for any outstanding fees or obligations incurred prior to termination.
17. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the courts located in the State of Florida.
18. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed, and the remaining provisions shall remain in full force and effect.
